area. we have hit with downpour of rain off and on all day stopping as quickly as it started. in san francisco union square today the rain briefly stopped workers from putting up the annual christmas tree but only briefly. they got back to the job at hand. let's check in now with sandy to see what is on radar tonight. >> we have spotty showers around the bay area but what is getting interesting is the snow that has been developing. let's go to the live doppler and around the ukiah area near the clear lake north of clear lake you look very carefully we have had some pink showing up. mixed precipitation east of the ukiah area and north of lake port so the mountains there getting some colder moving in. where we are getting showers rate now. around monterey it's coming down. it's light to moderate at this hour. watsonville very light returns. we are far from through as you look at this the

wider picture here look at the lightning strike that we have been seeing just northwest of the bay area. they have been basically dissipating but we are seeing some lightning strike so keep it in mine. thunderstorm possibility in the poker. sierra nevada chain control on interstate 80. highway 50 state route 4 and 88. they are getting some snow so far half foot and counte counteding. now we have the potential for snow in the bay area. i'll be back to talk about it in a few minutes. >> what many people want to know about is whether it is time to bring out the skis and the snow boards already. one resort opening this weekend. though many are waiting. more now from annette in the sierra. >> on and off flurry xwreeted visitors during the opening day here. skiers and snowboarders were able to play in man made snow mixed in with the real stuff that fellas month. further north in the tahoe area opening day will have to wait a little longer. the first storm

that blue through last month gave people a teaser. with a couple of resorts opening for few day but then balmy weather set in. >> just really warm conditions. we all missed opening knowing it was going to be the case. >>reporter: last year early snow came but more didn't come until january. no one wants the repeat. now a new storm is blowing through giving resorts some hope they could open for good this season. snow making machine are fired up. employee are busy stocking up on wood and stores are putting out new merchandise for customers eager to update the winter wardrobe. >> good to have the door open. storm door open and as opposed to last year, jet stream dropping down moisture on the hill an bring temperatures down and get ready for great season. >>reporter: the mountain resort here hoping it stays cold enough through the next couple days to reopen on saturday. >> great for making snow

because it's cold temperatures so our snow gun are running at the max. >> high hope it's a good year. >> now we don't know yet if this is weather related but critical condition here after giant tree fill on him this morning in sonoma. sonoma sheriff's officials say large crane was lifting the tree to move it off the ground when the tree snapped in half falling on 33-year-old jerrad mras and again in critical condition. >> residents in san anselmo deal with second major sewage spill in a little more than a week. sanitation officials say this time a homeowner drove a stake into a pipe and about 10,000 gallons of raw sewage poured out over the past few days. workers stopped the leak after reported only today. now early last week 88,000 gallons of sewage leaked from another pipe in san anselmo. officials figured out the tree root caused that pipe to give way. woman is recovering from a terrifying 3 and a half hour

ordeal tonight and police are looking for the 2 people who put her through it it. kidnapped her. 57-year-old victim walking to her car in isolated parking lot in the shade land area of walnut creek last night. it was about 7:30 when this happened. >> she was confronted by 2 men. both what it male adults. they accosted her. of blindfolded her and bound and gagged her and put her in the back of her own car. >> woman was driven to various atm to drain money from her accounts. she was released in isolated section of the oakland hills. smaller older dark colored picp truck with a loud must haveler was seen leaving the area. the woman suffered minor bumps and bruises. well right now s.w.a.t. team mountain view are wrapping up a search of 2 apartment buildings where police say drug wrts being manufactured and sold. officers raided the 2 housing units on bush street that was about noon today in mountain view. they arrested 2 people and detained 3 others.

they found marijuana, meth and dmt hallucinogenic drug at that location. police say this could be the first dnt lab bust ever in the bay area. san jose police made surprising discovery during traffic stop. this man was arrested. james mcgill after pulling over his vehicle on first street. drunk driving suspicion but leif pipe bomb while searching his car was found. bomb squad safely detonated the did he vase. nobody injured. mcgill held on l possession of destructive device and dui and drug offense. oakland police say this sketch of a man who tried to kidnap a teenager tl is who they are looking for. happened yesterday in east oakland on 103 avenue near international boulevard. 14-year-old girl says this man grabbed her from behind and pulled her toward a red newer model dodge ram pickup truck with another man at the wheel. she managed to escape and gave police this

description. one year after they pitched tent on the steps of campus administration building uc berkeley demonstrators returned today for rally. while they celebrate the passage of proposition 30 they are worried about whether proceeds of this tax measure will really ultimately trickle down to them. laura has the story from plaza on campus. >>reporter: mood festive as couple hundred demonstrators march from the plaza but the message was a serious one. two days after california voters passed proposition 30 to raise tax for public education the students want to seat results. where it counts on the campuses and in the classroom. >> students pay way too much to have a public education like really ridiculous so i think we deserve as much money as we can

to get back the students. >>reporter: cal state university will see a rebate of 249 dollars bit end of the month. uc students have only a modest promise that their tuition won't go up the rest of the school year. >> no tuition increases here. we would like now to have tuition increases next year but depends on the level of state funding. >> prop 30 passion is definitely good news for the uc system. brings more stability to the financial situation for this year. >>reporter: demonstrators did march out of the rain and into wheeler hall. but unlick last year dramatic occupy protest so far there have been no tent on the ground or in the air. no violent clashes with police or pepper spray. this time just a simple plea for prop 30 revenue to somehow flow down to them. >> i don't think tuition needs to be cut but i know it is threatening to be raised and i don't think that's fair. >> i would like to make sure

there aren't like mass layoffs and like make sure we have all of our classes that we need like to graduate so we are not here for years. >>reporter: uc police have been very low key today and expect that to continue. if students decide to sleep out tonight a uc spokesman told me that they will continue this low key approach. they have learned a lot of lessons since last year and key words when handling demonstrations will be patience. at uc berkeley, abc 7 news. he cal state system is considering 3 fee hike to help push so-called career students out the door and create more space for new and current students. hike aimed at 3 kinds of students. those who have enough units to graduate but stay in school any way. those who repeat courses and the students who take more than a full time course load. fee would generate as much as 30 million dollars a year. cal state executives say the point here is to open up course space

generates more traffic. it's a story developed by our media partner california watch. non-profit project of the center for investigative journalism with the story tonight, david lou. >>reporter: i'm on the border menlo park. campus down the street but facebook expands it has a tremendous impact on the traffic. facebook is facing potential litigation from neighboring city so it agreed to pay them to mitigate the traffic impact east palo alto has received 650,000 dollars from facebook. half million dollars will be earmarked for traffic on university avenue. 150,000 will good towards bike path. >> things like loop so bicycle make the turn at intersections. doing improvement for pedestrians safety. so those are kind of things that really help and 150,000 dollars will go a long way. >>reporter: even th town here gets 350,000 because employees

now at highway 1 l steady light rain and we pan around to other parts of the bay area. san mateo county coast and out to highway 35 we are seeing a spotty shower developing. now to the north just around the mostly clear lake area south of ukiah. the pink on live doppler 7 hd mixed precipitation and rain and snow. under a winter weather advisory as they have already seen accumulating snow down to 2500 feet. here's a loop of the radar here. live doppler 7 hd and you will notice the lightning strike we have seen several lightning strike a good one 40 miles off the coast. not materializing yet but still potential for thunderstorms in the forecast through tomorrow. chain control heading to tahoe on all major routes. it's still snowing and they are going to be counting up to the a foot when all said and done. rainfall total it has been on the light side but you may have run in a brief downpour here

>> firefighters in menlo park grab more than just the boots and helmet when responding to emergency. now they will also grab their i-pad like this one. it is so they can have access to new app developed just for the department. it helps them guides them to the nearest fire hydrant. access to building layouts or let them look up information on hazardous materials. they can even track the location of the fire trucks as they head to a call. >> awe the information was originally existing to just paper form. we condensed it and integrated into the application. >> well other fire departments are already looking into the coping this specialize app.

boost the rebel forces. back at home. passage of proposition 36 this week signal a new cost conscious view of crime and punishment in the state revising california 3 strike law means that thousands of prison inmates could soon be back out on the street. tonight with the help of california watch part of the center for investigative reporting you will hear from 3 inmates awaiting their freedom. here is morning anchor eric thomas. [applause]. >>reporter: tuesday night was a chance to celebrate for supporters of proposition 36 initiative to scale back california 3 strike law. >> usually when people go to the poll they are voting to increase penalty. this is one of the few times actually in u.s. history where they said no. it's too harsh. >>reporter: no one was paying more attention to the vote than this group of prisoners at san quentin called hope for strikers. the group has been meeting for many years to bring awareness to the 3 strike law. >> i'm ed griffin and i got 27

years to live for possession of cocaine. >> my third strike is burglary of unoccupied dwelling. it was my first relapse after being clean and sober for almost 10 years. >> my third strike was instigating a fight. it was a non-violent felony and they gave me 25 to life. >>reporter: so john has already served 16 years behind bars. he's one of the nine,000 third strike intercalifornia prisons and one of the 3000 who will be eligible for a rehearing because of prop 36. >> my second time in prison. and my first 2 strike came from one case when i was 18 years old. 2 burglaries. >>reporter: now a judge could decide to remove his life sentence. >> it's a life sentence gets taken off then chances are that i may end up going home. because i have so much time already in.

>>reporter: sutter county district attorney adams opposed prop 36. >> california voted for 3 strike because they were tired of this idea of people going to prison getting out committing another felony victimizing somebody else going back getting out creating another victim and so on and so on. >>reporter: michael romano who helped write prop 36 says the 3 strike law will remain the toughest in the country. >> it is really trying to address what we think are the most excessive sentences in the country. close to in the country history. >>reporter: california is one of 27 states with a 3 strike law before prop 36 it was the only state to impose life sentences for non-violent third strike. romano says this week vote will reduce the strain in california penal system. >> make sure our prisons are not over crowded with people who don't deserve to be there and also helps people who have been sentenced to live for very minor non-violent conduct.

>>reporter: since 3 strike tl passed in 1994 crime has dropped but also dropped in other states that doesn't have 3 strike. politician across the country are questioning whether benefits of laws like 3 strike outweigh the cost. >> we need a safe country. i want to live in a safe neighborhood everybody does but we ought to look at the correction system and say is this really the way to do it? is there another way to do it? which could save us money and still keep us safe. i think there might be. >>reporter: as member of the senate judiciary committee senator durbin of illinois haas is doing a broad review of prison other policy. >> voters want to make sure those in government spend their money well and not wasting it. i also think they don't want america to be known as a country that does inhumane thing to the prisoners and incarcerates them unfairly for any lengthy period of time not justified. >>reporter: this week vote signal a new direction for california which was at the fore front of introducing law like 3 strike.

>> all eyes on california here. california started this trend as it starts so many trends and people are really lack to go see what people in the state are going to do with 3 strike law. >>reporter: adam director of public policy safety research at the center on the state says other states have also started to temper sentencing laws. >> those states may willing to revisit what they have done and may go a little further and other half of the state that haven't broached this issue in a serious way will probably say maybe now it's time. >>reporter: mean time for thousands of california inmates like john, prop 36 may now offer a chance at fresh start. >> i'm glad that people of california are having a chance to take a second look at this i'm hopeful. very hopeful. >>reporter: this is abc 7 new news. now to story about an arizona man who spent more than 3 decades in prison for a murder he says he did not commit. 77-year-old bill said he was innocent from the start saying he was framed by his

wife. now a judge is finally set him free. here's dan. you are looking at the first moment of freedom for man who hasghte spent 30 plus years trying to convince the world he's innocent. >> big day. family day, in the 1970's bill was convicted of killing 2 young adults in the desert of arizona. his son ron grew up believing his dad was a monster. until several years ago when he got a call from a lawyer telling him. >> i think your father is innocent and we are pretty sure your mom framed him. >>reporter: at the time of the arrest bill and carol's marriage was falling apart and carol was working at the local sheriff's office where she had access to the evidence in the murders. >> i don't have any doubt any more that my mom did this. >>reporter: did you frim your husband. >> no. absolutely not. >>reporter: we tracked ron's mother down and she agreed to this her first and only tv interview. the notion that your son would say that you are
